Ban sound polluting motors of Comfort Golden Dream and other projects

The regular readers of my site might have been noticed about my endeavor to focus the issue of sound pollution of a construction site, though committing just opposite to my resident at Pallabi, Dhaka in Bangladesh , including other sites of other legal and illegal developers frequently seen in many parts of Dhaka, even outside Dhaka .

The plea of citizen about the problem faced in terms of sound pollution caused by any particular person or group should be respected by a Democratic Government. I should further stress on my plea that it has solid ground as the bizarre, unbearable sound pollution is disturbing and causing harm to my health. Since the conventional environmental laws of Bangladesh have conveyed solidarity, I am very pleased that Judiciary system of Bangladesh has done a good job and I should just beg remedy from that. Otherwise tempering or disloyal to the laws means the authority is loyal to the violator, on the other hand, disloyal to the interest of the citizen. The awkward approach to dismantle the bindings of environmental laws of Comfort Golden Dream at the same time abstaining from taking action highlighting to the legitimate plea of a citizen from the concerning authorities are sufficient to prove that present Monopoly Government lead by Bangladesh Awami League with conjunction of a former Military dictator Hussain Muhammad Ershad is an approach may verily portrayed as ‘Dictatorship'. Bing elected through so called democratic approach, passing relentlessly on the path of misappropriation, nepotism; non-compliance with the conventional laws is clear indication that the future of the Government is very alarming.

It is 6 past 7 AM on 4 February-2012 – just finished my Fajar prayer and shall start for the day, a bizarre, troublesome, noisy environment has heated the parameter of my anger, of course anger of other people, since it is unbearable and intolerable. Yet it is happening and neither any action from the side the Ministry of Environment nor from the Ministry of Local Government or Ministry of Housing has been taken so far, though the matter has been sighted to a piece of writing in my website and has been hosted for a long. It is one kind of environmental terrorism so exercised in a project titled by COMFORT GOLDEN DREAM of Comfort Living Ltd. (Address: Head Office, House: 7, Road: 2/2 Banani: Dhaka-1213 Phone: 028815306) under the patron of local notorious and once convicted criminals harbored by the MP of the local area Illias Uddin Molla and local City Counselor Ismail Hussein.

According to section 17(4) of Dhaka Municipality Building Rules (Building, Development, Conservation and Removal) 2008, no building developer is allowed to create any irritant sound at its sight. In addition to the laws related to Environment do not permit in doing such work too. Having available such progressive and on-time and modern rules, those are not being enforced and consequently my valuable times have been sacrificed to prepare such plea rather than to the jobs required to do by me that may bless the countrymen.

For last one and half month the developer has been piling with the aid of a machine operated by a very old motor, most probably donated from so called developed countries so that the Bangladesh may be fucked. Sound is measured by the unit of decibel, and there is a certain limit that may be tolerable to the human body, beyond that limit, the perpetrators doing that is entitled to be charged for. When Bangladesh Awami League (BAL) lead Government is trumpeting to bring the rule of law in the country; pounded by sound, air and other pollution around the construction sites in particular and other premises at large should also be given priority to be accounted for.

It may be tolerable if such awkwardness of a section might bring economic prosperity, however, various indexes of economics has shown that the health of the economics of Bangladesh is sick and many claim that the Government has totally failed to tackle the economy. Few days ago the leaders of BGMEA claimed that the export has been declined due to inadequet supply of gas, electricity and other facilities. At the same time an advertisement of Bashundhara Group where their LPG solution has been offered for the Garments sector has made many questions. Just in the time of cooking dinner is intentionally done and many new real homes have been deprived of getting new gas connection. This problem has been intensified during the era of present GOB and it can be summarized that for the sake of LPG companies like Kleenheat, Bashundra or other inertest groups might have been infiltrated to cause such artificial shortage. In such a moment when the GOB has failed to eliminate such crises and relentlessly looking after the interest of a few rather than the mass, I am confident that GOB must loose the ground of support and since I am personally victimized to refrained from doing any job pleasantly from the influx of sound pollution, I am personally boiling up being hoped to be seen any instance which may please me and eliminate to my problem. Such individualistic approach may occupy the aspiration of many and when it shall be tuned on by any organization or political party, often articulate the interest of the mass, shall be popularized and respected. Unfortunately the opposition parties have also failed to focus this problem of the GOB. We do not expect any downslide of the development work in the housing, rather, we must point out the problem where motors creating sound pollution in the name of piling must be substituted by the motors available in the machinery shops those do not create sound pollution and also press on demand to supply guidelines so that any pollution caused for their deed may not harm to the public health.

The paid officers of the Ministries are wholly responsible to ban such motors; if they do not do, there shall be every possibility to be supplicated that they are being induced. If the beaurocrats are hampered by the apex two persons, let it be focused and unless the rule of law is sustained, nothing to be boasted of.

Follow up on 5 February-2012:

The responsible persons of the project COMFORT GOLDEN DREAM has stared their piling venture at 35 minutes past 6, 25 minutes earlier and though they have changed the motor that drug muddy water in the truck and has replaced by a motor available in the market is also noisy and the problem of creating bizarre sound is remained same in comparison to the situation of the last day. It is notably mentionable that the projects so run by other developers whether it is private level, public level, use such irritating sound pollution – can never be given mercy. It is related to the public health and the GOB is committed to take prescribed action which may cause the perpetrators to be refrained from.

Follow up on 07 February-2012:

Neither any adequate measure to replace noisy motors no any approach to remove building materials causing public nuisance and the action of the authority is far off!

Follow up on 12 February-2012:

The motor which was replaced on 4 February 2012 has been replaced by the sound polluting motor, used before so that I may bind to clash with them. No law enforcing agency is active here.

Follow up on 16 February-2012:

I felt relieved from the sting of sound pollution because of out of order of the motor today morning. Replacing the old one with soundproof motor may unravel the setback for the reason I have to be agitated.

Follow up on 22 February-2012:

No improvement has yet to get and it is quite absurd how a project takes nearly one month to pile the pillars using sound polluting motors and administration remains indifferent! In this circumstance, it can be vigorously noted that here democracy is serving the taut having manipulated the mass people who should be treated and protected by the law. It may be further noted further that though the conventional law supports my claim, judiciary and executive body of Bangladesh virtually inactive because of relentless manipulation by the interest group. This observation is enough to diagnose the health of our democracy.

Follow up on 25 February-2012:

No improvement has yet to get and it is quite absurd how a project takes nearly one month to pile the pillars using sound polluting motors and administration remains indifferent! In this circumstance, it can be vigorously noted that here democracy is serving the taut having manipulated the mass people who should be treated and protected by the law. It may be further noted further that though the conventional law supports my claim, judiciary and executive body of Bangladesh virtually inactive because of relentless manipulation by the interest group. This observation is enough to diagnose the health of our democracy.

Follow up on 28 Februaryr-2012:

Situation remained same and no action has yet to see from the authority to make debarred the sound polluter- real estate developer particularly in front of my house from doing so.

Can you imagine that a dense populated area has to suffer from sound pollution by means of their venture to piling with defective motors for one month and will continue in the future? The state mechanism is totally failed to protect the helpless citizens from the hooligans of the real estate developers.
